ROUNDSTerms of Use
These terms are an agreement between you and Garrenteed Labs LLC ("we", "us") covering the ROUNDS apps and the optional account and sync service. Please read section 2 in particular — it is about your health, and it matters more than the rest.
1. Accepting these terms
By using ROUNDS you agree to these terms. If you do not agree, do not use it. We do not keep a record of which version of these terms you agreed to, so your continued use of ROUNDS after we publish a change is how you accept the changed version. Every change is dated in the change log at the foot of this page.
2. Your health, and the risk of injury
ROUNDS is a timer, not a medical device and not a coach. It does not know anything about your health, your injuries, your fitness or your limits. It cannot tell whether an exercise is safe for you.
Talk to a doctor before starting any exercise programme, and especially if you have a heart condition, are pregnant, are recovering from an injury or illness, take medication that affects your heart rate, or have not exercised in a long time. Stop immediately if you feel pain, dizziness, faintness or shortness of breath, and seek medical help.
Heart-rate figures shown by ROUNDS come from a Bluetooth heart-rate device you connected, or from an Apple Watch running the ROUNDS watch app. They are estimates for training, not diagnostic readings, and the training zones are calculated from an age set in Settings, which defaults to 34 until you change it. Do not use them to make a medical decision.
You are responsible for how you exercise. You take part at your own risk.
3. Your account
You can browse ROUNDS without an account; starting a workout asks you to sign in, and a TV app — on Apple TV or Android TV — asks before anything else. Once you have an account, you are responsible for keeping your sign-in details secure and for what happens under your account. Tell us at {{MAINTAINER: SUPPORT_EMAIL}} if you think someone else has access to it. You can delete your account — see deleting your account.
4. The sync service
If you sign in, your saved workouts and your completed-workout history sync between your devices. Your heart-rate data, calories and age are not part of that: we never receive them. They are included in your device's own operating-system backup if you have that switched on — the privacy policy sets out exactly what is and is not transmitted. Connecting ROUNDS to another service is separate, and section 4a covers it.
Sync is provided as it is. We do not promise it will be available without interruption and it is not a backup service. Keep anything you cannot afford to lose somewhere else.
4a. Connecting other services
ROUNDS can be connected to another service, such as Strava. If you connect one, you authorise us to hold the access and refresh tokens that connection needs, when they expire, the permissions you granted, your identifier at that service and the name on your account there, and you authorise ROUNDS to send that service the workout data described on the consent screen shown before you connect.
For Strava, that consent covers every workout you finish on that device, from the moment you connect until you disconnect, without asking you again each time. It includes your heart-rate graph, at roughly one reading every few seconds, whenever you wear a strap. Workouts you end early are not sent, and workouts recorded on your watch are not sent. You can disconnect at any time; disconnecting stops all future uploads and deletes anything still waiting to be sent. What that service does with the data once it has it is governed by that service's own terms, not by these.
5. Content you create
Workout names, cue text and run labels are yours; you keep whatever rights you have in them. You give us permission to store them and to show them back to you on your devices, which is all we do with them. Do not put anything unlawful, abusive or infringing into them, and do not put anything private into a workout name — nothing filters what you type, and names appear in workout summaries you share.
6. Acceptable use
Do not attempt to break, overload or gain unauthorised access to the service or to anyone else's account; do not use it to build a competing product from its data; and do not use automated means to hammer it. We may suspend an account that does.
7. Subscriptions
Some features require a paid subscription. Subscriptions are sold and billed by the App Store or by Google Play, not by us. Where a free trial or introductory offer is shown, it converts to a paid subscription at the standard price when it ends unless you cancel before then; the length and the price are shown by the store before you buy. Payment is taken by that store, the subscription renews automatically until cancelled, and cancellation, refunds and billing questions are handled by that store under its own terms.
Cancel through the store you bought from — see support for where. Deleting your ROUNDS account does not cancel a store subscription, and uninstalling the app does not either.
8. Availability and changes to ROUNDS
We may change, suspend or stop any part of ROUNDS, including the sync service. Where a change would materially reduce what you already paid for, we will give reasonable notice where we can.
9. Liability and assumption of risk
Nothing in these terms limits liability that cannot be limited by law. In particular, we do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law of your country does not permit us to exclude. If you are a consumer, you keep all the rights your local consumer law gives you and nothing here takes them away.
Subject to that: ROUNDS is provided as it is and as available, without warranties of any kind, whether express or implied. You acknowledge that physical exercise carries an inherent risk of injury, that ROUNDS neither supervises nor assesses your exercise, and that you assume that risk. To the fullest extent the law allows, we are not liable for indirect or consequential loss, for lost data, or for loss arising from your use of ROUNDS to structure exercise, and our total liability is limited to the amount you paid us in the twelve months before the claim.
10. Minors
ROUNDS is not directed to children and may not be used by anyone under 13. If you are between 13 and the age of majority where you live, you may use ROUNDS only with the consent of a parent or guardian, and that parent or guardian agrees to these terms on your behalf.
We do not enforce these terms against a minor where the required parental consent was not given. We do not ask for, collect or store any age category, and we do not use any age-signal service.
11. Ending this agreement
You can stop using ROUNDS at any time and delete your account. We may suspend or end your access if you materially breach these terms. Sections 2, 5, 9 and 12 survive.
12. Governing law
These terms are governed by the law of {{MAINTAINER: GOVERNING_LAW}}, and the courts of {{MAINTAINER: GOVERNING_LAW}} have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory law of your own country.
